6. Binding Arbitration Clause, Arbitrator Fee & Jurisdiction

Any dispute, claim, controversy, or grievance arising out of, in connection with, or relating to the use of NPADoctor.com, its legal content, or any services referenced herein shall be finally settled through Binding Sole Arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India (as amended).

Designated Arbitrators, Seat & Fee Terms:

  • Designated Sole Arbitrator: All arbitration proceedings shall be referred to and adjudicated by Adv. Ravi Kiran or Adv. Ankit of Panchkula as the Sole Arbitrator.
  • Seat & Venue Flexibility: The seat, venue, and place of arbitration proceedings shall be Panchkula or Chandigarh, to be decided and can be interchanged by the Arbitrator(s) at their sole discretion.
  • Arbitration Fee & Advance Deposit: The professional fee of Arbitration shall be determined and decided by the Arbitrator(s) and must be deposited in full, in advance, by the party raising the dispute / initiating arbitration, along with all administrative, secretarial, and hearing expenses deposited on an actual/incurring basis.
  • Language & Award Finality: The language of arbitration shall be English, and the arbitral award passed by the Sole Arbitrator shall be final, conclusive, and binding upon all parties.
  • Territorial Jurisdiction: Subject to the arbitration clause above, the competent courts situated at Panchkula / Chandigarh shall have exclusive territorial jurisdiction over any statutory court proceedings.
